ABSTRACT

The article deals with the relations of the head of the state and executive branch led by Prime Minister in the conditions of the Slovak Republic. The aim of the article is to point out to this relation and to the mutual position of the highest state organs characteristic for the Slovak parliamentary form of the government. Although, the power distribution triangle operates within the parliamentary system of government we may observe several interesting features. It is not always an universal example of the weak position of the president and strong position of the PM or the government itself. Even the decisions made by the Constitutional Court of the Slovak Republic have shown that the presidential institute and its decision making strongly influences the office settings of many important legal and constitutional mandates within the Slovak political system. The executive power in Slovakia is thus based over two important aspects whose relations determine whether the performance of the executive is consistent or confrontial.

Key words: president, appointive powers, Constitution, presidential powers
