Abstract

The aim of the article is to summarize theoretical knowledge in the sphere of conceptualization of the militant democracy. Author introduces present terminological situation in frame of social sciences, and the efforts of the classification of democracy defense model against its ideological enemies. He points out the theoretical roots of the concept founder Karl Loewenstein, and concept extension and application by European democratic states. Author discusses the dilemmas of the concept. He considers the measures between ensuring the state security and restriction of the human rights and fundamental freedoms. The most serious risk of present democratic governments presents exaggerating reaction on the terrorist threat, relating with government resorting to political radicalism in the sphere of judging the criminal offences. The core of the article is represented by focusing on law and political application the components of militant democracy concept in the Czech anti-extremist policy.
